1. Purchaser accepts the full responsibility of caring for this kitten, providing properly for its welfare, and to follow breeder’s instructions regarding care, housing, diet, and health. This includes but is not limited to providing: prompt medical care including vaccines, worming, flea treatment, and annual veterinary examinations; providing exercise and toys and not to cage it unnecessarily or for prolonged periods of time.
2. Under no circumstances will this kitten be sold, leased or given away to any pet shop, shelter, research laboratory, or similar facility.
3. This kitten will not be allowed to roam freely outside unless it is leashed at all times and accompanied by a responsible person.
4. Purchaser agrees to neuter or spay this cat between the ages of 3 and 7 months WITHOUT EXCEPTION.
5. Upon receiving written proof of the neuter or spay from the veterinarian, the official TICA kitten registration slip and a copy of the pedigree will be mailed to the Purchaser.
6. Purchaser agrees and guarantees that this kitten WILL NOT be used for stud or breeding.
7. This kitten may not be resold, leased, bartered, or given away without first being spayed/ neutered, unless returned to the original seller
8. No cash refunds.
9. If this cat or kitten is found to be neglected or mistreated, Purchaser will surrender said cat or kitten to Seller, unconditionally.
10. Purchaser agrees that if any of the terms stated in this contract are disregarded, the breeder may reclaim this kitten with no refund. The buyer agrees to pay for all court costs if this contract is litigated. Litigation will be in or near Hallstead, Pa.
11. The Seller reserves the right of first refusal to reclaim this kitten from the buyer, if the buyer for any reason cannot keep this kitten any longer. Seller has the option to find a new permanent home for the kitten. Seller has the right to cancel sale at any time before the kitten is shipped/picked up.
12. This cat or kitten is being fed Purina One Kitten Formula Dry food, and is using Pine Pellet litter. If choosing to switch, Purchaser agrees to follow the instructions provided with the kitten to ensure a healthy transition.
Seller guarantees that the breeder’s cattery is FeLV negative, and that all felines are provided proper medical care, housing, and socialization. The kitten is guaranteed to be of sound health (free of any parasites or disease) upon arrival. It is guaranteed for a period of 72 hours from time of purchase (arrival) if vet-checked within that time. It is important that the new kitten be in quarantine during this time. If it is found to be medically deficient with an untreatable or life-threatening problem, it must be reported to the Seller immediately. It is the responsibility of the Purchaser to notify the Seller immediately of intent to return the kitten and to return the kitten to the Seller within 7 days of the time of purchase (arrival). Upon its return, accompanied by a veterinarian’s certificate detailing said health problem, the kitten will be replaced with another kitten of equal value or the full purchase price will be refunded. If no replacement is available at that time, seller will have 6 months to furnish a satisfactory replacement if the Purchaser is not interested in a refund. The kitten cannot be returned after the guarantee period has expired and/or if it has been exposed to another animal. It is the responsibility of the buyer to provide immediate veterinary care to any cat/kitten showing signs of illness or distress and failure to do so will render any guarantee null and void. Under no circumstances is a kitten to be destroyed prior to notification by the buyer to the seller.
This kitten is guaranteed against congenital defects for one year. Should the cat die within that time as a direct result of a congenital defect, the cat will be replaced ONLY if an appropriate autopsy is performed by a licensed vet and a vet's certificate is provided as proof of cause of death. A replacement will be made of a cat of comparable quality and value, as available, at the discretion of the breeder at no additional cost, except for shipping fees – if applicable.
This contract is legally binding to all parties involved. It applies only to the Purchaser and Seller in this transaction and is non-transferable to other parties.
